The City and County of San Francisco (San Francisco or the city) enacted a local anti-discrimination ordinance that prohibits discrimination based on race; color; ancestry; national origin; place of birth; sex; age; religion; creed; disability; sexual orientation; gender identity; weight or height.1
It applies to all employers except for businesses with five or fewer employees including the owner, managers and supervisors.2
San Francisco also requires employers to make “readily achievable modifications in the workplace including, but not limited to, accessible furnishings, workplace layout, and equipment” to ensure that common areas are accessible to people of all sizes.3This ordinance also requires you to display a notice posted in a conspicuous place.4
The ordinance is enforced by San Francisco’s Human Rights Commission (the Commission).5 The Commission may conduct investigations and mediate discrimination complaints or refer the matter to the City Attorney who may file a lawsuit. In addition, aggrieved employees may file a civil lawsuit for any violation of the ordinance.
