The City and County of San Francisco (San Francisco) enacted a Drug-Free Workplace Ordinance (DFWO) that requires employers to adopt a “Drug Free Workplace Policy.”1

At a minimum, the policy should include the distribution or display of educational information regarding the adverse effects of using illegal drugs and the availability of substance-abuse assistance programs.2

Coverage and Eligibility

A covered employer (employer) under the DFWO includes all employers (except governmental entities) located within San Francisco.3

A covered employee (employee) under the DFWO is any person working for salary or wages in San Francisco. Individuals providing child care or other personal services in one’s home are exempt from the DFWO.4

Posting Requirements

The San Francisco Board of Supervisors provides a statement for employers to post or distribute that satisfies the policy requirements.5

Enforcement

San Francisco does not impose any penalties or liability for employer violations.6
