Am I required to have a sexual harassment policy and distribute it to employees?

Yes. Employers have an affirmative duty to create a workplace environment free from harassment and discrimination and part of this obligation includes developing a written harassment, discrimination and retaliation prevention policy (2 CCR section 11023 (b)).

The policy must be distributed to all employees with acknowledgment of receipt.

If 10 percent or more of the workforce at any facility or establishment speak a language other than English, you must translate the policy into that language(s).

Employers are also required to post a required notice and distribute a required anti-harassment brochure.
