Both federal and state law have Drug-Free Workplace Acts, which impose legal obligations on employers who enter into a government contract for the procurement of property or services valued at $100,000 or more, and on any group that receives a federal grant in any amount. The contracting entity is required to certify to the government agency issuing the contract that the contractor maintains a drug-free workplace. This certification requires an employer to create a plan that provides for a drug-free workplace, too.
