May I search my employees' desks and other things, such as lockers?

California law is somewhat unsettled in the area of searches of employee and employer-owned property in the workplace. An employer should establish a policy that eliminates any reasonable expectation that company property (such as desks, lockers and computers) is private.

Employees' personal property (such as purses, briefcases and cars) should not be searched without advice of legal counsel.

You can find more information in the Property Searches section of the HR Library.
