Am I required to provide sick leave for employees?

Yes, employers with workers in California must provide paid sick leave benefits under the Healthy Workplaces, Healthy Families Act. Employers must provide paid sick leave to any employee who has worked in California for the same employer for 30 days within a year from the beginning of employment. The law also has specific provisions regarding accrual and use.

Employers must post the required paid sick leave poster and provide new hires with information about paid sick leave as part of the Wage and Employment Notice to Employees (Labor Code section 2810.5).

In addition to the state law, several local ordinances also may require you to provide paid sick leave to employees. Employers must provide the most generous benefits and protections to the employee.

Remember: You may also have an obligation to provide unpaid time off work in the form of reasonable accommodation under the Americans with Disabilities Act and state disability discrimination laws, and to provide family/medical leave under state and federal law if you have a certain number of employees or are a public employer.
