Am I required to provide a written termination notice for the UI program?

Unemployment Insurance (UI) Code Section 1089 requires that employers give immediate written notice to an employee of a change in the employment relationship, including discharge, layoff, leave of absence, and change in status from employee to independent contractor. No particular form is required for the notice; however the notice must include the name of the employer, the employee's name, social security number, the date of the action and the action taken. The reason for the action is not required.

The employer may create their own notice or use the sample form created by the Employment Development Department (EDD). The notice must be given to the employee and a copy should be retained for the personnel file.
