Yes — but only if the employee is the sole member of a properly defined work unit.
An employer cannot create an alternative workweek for a single employee by agreement alone. However, a work unit may consist of one employee if it is a “readily identifiable work unit” (e.g., a department, shift, or location), as recognized in IWC guidance and Labor Code Section 511.
Even in this case, the employer must follow the full adoption process required by the IWC orders and Labor Code.
