Are there different alternative workweek rules for the health care industry?

Yes. Certain healthcare employees may work alternative workweek schedules with shifts of up to 12 hours within a 40-hour workweek, with longer shifts allowed in limited circumstances.

Overtime rules differ:

  • Double the employee’s regular rate of pay for hours worked over 12 in a workday
  • 1.5 times the employee’s regular rate of pay for hours worked over 40 in a workweek

Employees on 12-hour shifts may be required to work additional hours in defined healthcare emergencies, and up to 13 hours if a replacement employee fails to report as scheduled without sufficient notice.
