If an employee refuses to come back to work after being released from pregnancy disability leave, what can I do?

If an employee refuses to return to the previous job for personal reasons rather than disability or other protected leave, the employee gives up all legal rights to return. At that point, the employer may — but is not required to — negotiate a different job or hours just as you would with any employee who had not been on a leave who requests such a change.
