Generally, if driving is an essential job duty and alternative transportation would not be comparable in time or cost, an employer may require an employee to use their own vehicle. Employers should disclose this requirement before hiring — for example, in job descriptions, advertisements or interviews — to avoid misunderstandings or disputes.
Employers should verify that employees required to drive have a valid driver’s license and minimum insurance coverage.
Under Labor Code Section 2802, employers must reimburse employees for all necessary expenses or losses incurred in the course of their duties, including the cost of using personal vehicles for company business.
