Is there a minimum number of hours I must pay an employee who reports to work?

You are not required to schedule an employee for any minimum number of hours in a workday. However, each workday an employee is required to report and does report for work, but works less than the scheduled workday, the employee must be paid for at least half the usual or scheduled workday, up to four (4) hours, but in no event for less than two (2) hours. Where there are no usual or scheduled hours the employee must be paid a minimum of two hours of reporting time pay.

The Labor Commissioner interprets this section to not preclude an employee from entering into a part-time work contract or agreement to work for less than two hours per day. In such cases, there is no reporting pay penalty. For example, a relief cashier agrees to work one hour each day on a regular basis. No additional reporting time pay is due.
